6. Cookies and Similar Technologies

  • What are Cookies? Cookies are small text files that are stored on your device (computer, tablet, smartphone) when you visit a website. They help the website remember information about your visit.
  • How We Use Cookies:
    • Essential/Strictly Necessary Cookies: These are necessary for the Website to function properly and cannot be switched off in our systems. They are usually only set in response to actions made by you which amount to a request for services, such as setting your privacy preferences.
    • Performance/Analytical Cookies: These cookies allow us to count visits and traffic sources so we can measure and improve the performance of our site. They help us to know which pages are the most and least popular and see how visitors move around the site.
      • Google Analytics: We use Google Analytics, a web analytics service provided by Google LLC (USA). Google Analytics uses cookies to help us analyze how users use the Website. The information generated by the cookie about your use of the Website (including your IP address) will be transmitted to and stored by Google on servers in the United States. We have activated IP anonymization on this Website (e.g., by using the _anonymizeIp() feature or relying on GA4's automatic IP masking), so your IP address will be truncated by Google within Member States of the European Union or other parties to the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be sent to a Google server in the USA and shortened there. Google will use this information on our behalf for the purpose of evaluating your use of the Website, compiling reports on website activity, and providing other services relating to website activity and internet usage. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.
      • You can prevent the storage of cookies by Google Analytics by setting your browser software accordingly; however, we point out that in this case, you may not be able to use all the functions of this Website to their full extent. You can also prevent the collection of data generated by the cookie and related to your use of the Website (including your IP address) by Google and the processing of this data by Google by downloading and installing the browser plug-in available under the following link: https://tools.google.com/dlpage/gaoptout.
      • For more information on Google's privacy practices, please visit https://policies.google.com/privacy.
    • Functional Cookies: These cookies enable the Website to provide enhanced functionality and personalization.
  • Your Choices Regarding Cookies: Most web browsers allow you to control cookies through their settings preferences. You can set your browser to block or alert you about these cookies, but some parts of the site may not then work. For more information on how to manage cookies, check your browser or device's help material.

7. Data Sharing and Disclosure (Recipients of Personal Data) We do not sell your personal data to third parties. We may share your personal data in the following limited circumstances:

  • Service Providers: We may share your data with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work. These providers are contractually obligated to protect your data and may only use it for the purposes for which we disclose it to them.
    • Hosting: Our Website is hosted by Ghost Foundation on servers primarily located in Amsterdam, The Netherlands. For more information, please see Ghost's Privacy Policy: https://ghost.org/privacy/.
    • Analytics: As described in Section 6, we use Google Analytics, a service provided by Google LLC (USA).
  • Legal Requirements and Law Enforcement: We may disclose your personal data if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency), or to protect our rights, property, or safety, or that of our users or others.
  • Business Transfers: In connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company, your personal data may be transferred.

8. Data Transfers to Third Countries If we transfer your personal data to service providers located outside of Switzerland and the European Economic Area (EEA), we will ensure that appropriate safeguards are in place to protect your data in accordance with Swiss data protection law.

  • Ghost Foundation (Hosting): Our hosting provider, Ghost Foundation, primarily uses servers in The Netherlands (EEA). Data transfers to the EEA are generally considered to have an adequate level of protection from a Swiss perspective. Ghost's privacy policy (https://ghost.org/privacy/) provides more details on their data processing practices, including their use of sub-processors which may be in other countries; they state they take measures to ensure data is protected.
  • Google Analytics (Google LLC, USA): Google LLC is based in the USA, which is considered a third country that may not provide the same level of data protection as Switzerland or the EEA. To ensure an adequate level of protection for data transferred to Google in the USA, we rely on:
    • Google's implementation of Standard Contractual Clauses (SCCs) as recognized or approved under Swiss data protection law.
    • Your explicit consent, if obtained via our cookie consent mechanism for the use of Google Analytics cookies.
    • We have also enabled IP anonymization features for Google Analytics as an additional safeguard.

For other transfers to third countries not providing an adequate level of protection, we will rely on appropriate safeguards such as SCCs, your explicit consent after being informed of the risks, or other derogations permitted under the FADP.

9. Data Retention We will retain your personal data only for as long as is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

  • Server log files are typically stored for a limited period for security and diagnostic purposes.
  • Data from contact inquiries will be kept as long as necessary to resolve the inquiry and for any follow-up or legal record-keeping.
  • Data collected by Google Analytics is subject to Google's data retention policies.
  • For cookies, the retention period varies depending on the type of cookie.

When we have no ongoing legitimate business need to process your personal data, we will either delete or anonymize it, or, if this is not possible (for example, because your personal data has been stored in backup archives), then we will securely store your personal data and isolate it from any further processing until deletion is possible.

10. Data Security We have implemented appropriate technical and organizational security measures designed to protect the security of any personal data we process. These measures aim to prevent unauthorized access, disclosure, alteration, or destruction of your personal data. However, please remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security.

11. Your Data Protection Rights (under Swiss FADP) Under the Swiss Federal Act on Data Protection (FADP), you have the following rights regarding your personal data:

  • Right to Information (Access): You have the right to request information about whether we process personal data about you and, if so, to receive a copy of that data and other relevant information.
  • Right to Rectification: You have the right to request the correction of inaccurate or incomplete personal data.

  • Right to Restriction of Processing: You have the right to request the restriction of the processing of your personal data under certain circumstances.
  • Right to Data Portability: You have the right to receive the personal data you have provided to us in a structured, commonly used, and machine-readable format, and to transmit this data to another controller, where technically feasible and under certain conditions.

You also have the right to object to the processing of your data by Google Analytics as described in Section 6.
  • Right to Withdraw Consent: If we are processing your personal data based on your consent (e.g., for certain cookies via a consent banner), you have the right to withdraw your consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
  • Right to Lodge a Complaint: You have the right to lodge a complaint with the competent supervisory authority, which in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC): Federal Data Protection and Information Commissioner (FDPIC) Feldeggweg 1 CH - 3003 Berne Switzerland Website: http://www.edoeb.admin.ch
